The New Jersey Business & Industry Association (NJBIA) argues that the state's proposed Resilient Environments and Landscapes (REAL) rules will hinder many municipalities from meeting their affordable housing goals, as required by recent legislation. The rules expand flood risk zones and require structures to be built five feet above current flood elevations, relying on what NJBIA calls outdated and unreliable data on sea-level rise. NJBIA claims these regulations will effectively create “no build” zones and impose stricter stormwater rules, making urban and suburban development challenging, and thereby undermining the state’s affordable housing objectives.
